ADDITION AND AMENDMENT ENVISAGED IN RA LAW ON MANAGEMENT OF
APARTMENT BUILDINGS

YEREVAN, DECEMBER 1, NOYAN TAPAN. At the November 30
sitting, the Armenian government approved the draft law on
making an addition and amendment to the RA Law on Management of
Apartment Buildings, which will be submitted to the RA National
Assembly. According to the RA Government Information and PR
Department, the draft's necessity was conditioned by the need to
regulate the issues related to transfer of land plots necessary
for the servicing and maintenance of apartment buildings to the
owners of apartment buildings and constrcutions built on land
plots representing state and community property.
According to the decision on the order on gratis transfer
of the land plot necessary for the servicing and maintenance of
the apartment building constructed on state and communty lands
to the owners of this building's apartments and/or
non-residential areas by the right of common shared property, a
land plot transferred gratis by the right of common shared
property shall be considered:
a) for an apartment building without constrcutions - the
land area immediately under the building along its perimeter, as
well as the soil layer (up to 1.5 meters) in case it is not part
of a road, street or property of another person;
b) for an apartment building with legal or unauthorized
constructions - the above mentioned land area and the land under
the legal constrcution along its perimeter in case it is not
property of another person.
It was decided that the state registration of the common
shared property right of the owners of apartment buildings with
unauthorized constructions is done with respect to the land area
indicated in point "a" of this decision, while land areas with
annexes are managed by the order envisaged by point "b".
It was noted that the draft law regulates issues related to
demarcation of the boundaries of land plots transferred gratis
by the common shared ownership right and the state registration
of these rights.
