EXAMINATION OF CITIZENS' INDIVIDUAL APPLICATIONS STARTS AT
CONSTITUTIONAL COURT

YEREVAN, SEPTEMBER 12, NOYAN TAPAN. Examination of
citizens' first 2 individual applications started on September
12, based on possibilities given by the RA constitutional
reforms. Citizens Manushak Kocharian's and Hranush Davtian's
united applications in 1 examination relate to Article 11 of the
RA law on social security cards, which the applicants ask to
recognize as anti-constitutional. In the applicants' words, they
did not use the right of getting social card for religious
believes, what may not become an obstacle for implementation of
the exclusive right of a person's main social security, getting
pension. To recap, the applications were satisfied at the Court
of First Instance, and refused at the Courts of Appeal and
Cassation.
The CC inquiry response which was got from the social
security fund was made public at the CC. According to it,
payment of more than 1300 pensioners' pension was stopped for
the citizens' not getting pension more than 6 months
continuously. Meanwhile, in the words of citizens addressed to
the CC, they were not given pension for having no social card.
Rafik Petrosian, the Chairman of the RA NA State and Legal
Committee made a speech at the court as a respondant. He,
expressing the NA viewpoint, mentioned that the 2nd part of
Article 11 of the law "On Social Cards" contradicts the
Constitution and it must be recognized invalid by the CC: by the
mentioned principal, bargains concluded without social cards are
recognized invalid.
The CC interrupted examination of the applications till
October 3, new materials will be studied till that time by the
court as well as Social Security Fund Chairman Vazgen Khachikian
and RA Social Security Minister Aghvan Vardanian will be invited
to the court as adjacent respondants.
