BAN ON DISPUTING SIZES OF TARIFFS SET BY PUBLIC SERVICES
REGULATORY COMMISSION IN COURT RECOGNIZED AS CONTRADICTING

YEREVAN, JANUARY 16, NOYAN TAPAN. At the January 16
open-door sitting of the RA Constitutional Court, the case
initiated based on the application of 30 deputies of the RA
National Assembly was examined. The constitutionality of the
provision stipulated in the second sentence of Article 12 of the
RA Law on Public Services Regulatory Body was disputed.
By the decision published on the same day, the
Constitutional Court recognized as corresponding to the RA
Constitution the provision, according to which the sizes of
tariffs set by the commission are not subject to change by court
order. At the same time, the provision, according to which the
sizes of tariffs are not subject to disputing in court, was
recognized as contradicting Article 18 Part 1 and Article 43
Part 2 of the RA Constitution and as invalid by the RA
Constitutional Court.
